Welcome to Gogo Marketing, LLC. By accessing or using our website (https://gogomarketingllc.com) and our services, you agree to comply with and be bound by the following terms and conditions. If you do not agree to these terms, please do not use our services.

1. Definitions

  • “Company,” “we,” “our,” or “us” refers to Gogo Marketing, LLC.
  • “Client,” “you,” or “your” refers to any individual or entity using our services.
  • “Services” refer to website development, e-commerce solutions, SEO, Answer Engine Optimization (AEO), digital marketing, and any other services provided by Gogo Marketing.
  • “Website” refers to https://gogomarketingllc.com and any subdomains.

2. Scope of Services

  • We provide custom website development, SEO, e-commerce solutions, and digital marketing services tailored to each client.
  • Project details, timelines, and deliverables will be outlined in a separate written agreement or proposal.
  • Project completion timelines depend on the client’s responsiveness in providing necessary content, approvals, and feedback.
  • We reserve the right to decline projects that conflict with our company policies or values.

3. Payment Terms

3.1 General Payment Terms

  • Payments must be made according to the agreed terms in the proposal or invoice.
  • All payments are non-refundable unless otherwise specified.
  • Work begins only after the first payment is received.
  • Failure to pay on time may result in project delays or suspension of services.

3.2 Monthly Subscription Plans

  • Clients on monthly website maintenance or SEO plans must maintain payments to continue receiving services.
  • Missed payments may result in service suspension or termination.

3.3 Late Payments & Service Termination

  • Payments overdue by more than 5 days may incur a 5% late fee per week.
  • If an account remains unpaid for 30 days, services may be suspended or terminated.
  • Clients in a retainer agreement must complete their full contract term even if they cancel early or stop payments.
  • Early termination: If a client cancels before the contract is fulfilled, they will owe the remaining balance on their contract to the full base cost of services.
  • Gogo Marketing reserves the right to pursue legal action to recover unpaid balances.

3.4 Hourly Rates & Rush Pricing

  • Unless otherwise contracted, negotiated, or specified in a Scope of Work (SOW), the following hourly rates apply:

    • Standard Rate: $250/hr for the first 10 hours.
    • Extended Rate: $225/hr for hours 11-14.
    • Bulk Rate: $200/hr for hours 15+ when purchased in 5-hour blocks.
    • Rush Rate: $275/hr for expedited work requiring priority service.

4. Intellectual Property

4.1 Ownership of Work

  • Clients own the final website, content, and deliverables after full payment is received.
  • Gogo Marketing retains ownership of proprietary tools, code, and intellectual property used during development.
  • Clients may not reuse, resell, or modify Gogo Marketing’s proprietary work without permission.
  • Until all contractual payments are made, the website remains the property of Gogo Marketing.
  • Third-party assets (plugins, stock images, licensed tools) are not transferable unless the client purchases their own licenses.
  • Gogo Marketing reserves the right to display completed work in a portfolio unless a client requests confidentiality in writing.

4.2 Third-Party Tools and Plugins

  • Websites may use third-party tools, plugins, or APIs (e.g., WordPress, Shopify, analytics software).
  • Clients are responsible for any licensing fees associated with third-party software.
  • If Gogo Marketing licenses a plugin for the client, the client must purchase their own license if they discontinue services.

5. Client Responsibilities

  • Clients must provide branding materials, content, and approvals in a timely manner.
  • Failure to provide required content may result in project delays, but this does not negate the client’s responsibility to fulfill all payment obligations as outlined in their contract.
  • Clients must ensure that any submitted content (text, images, logos) does not infringe copyrights or trademarks.

6. Website Hosting & Security

6.1 Hosting Requirements

  • Gogo Marketing provides hosting as part of its website maintenance plans.
  • If a new domain is required, the client is responsible for all domain registration fees.
  • If the client has an existing domain, they must grant Gogo Marketing access or transfer it to our hosting platform for management.
  • Domains and hosting can be transferred back to the client at the end of the contract term, provided all outstanding balances are paid in full.
  • Clients may not transfer their website to another host until after completing their contract term.
  • If a client chooses to self-host after contract completion, they are responsible for all migration, setup, and security.
  • Clients on maintenance plans may receive regular updates, backups, and security monitoring based on their plan’s scope.

6.2 Domain Ownership & Transfer

  • Domains purchased through Gogo Marketing will only be released after full payment of all outstanding balances.
  • Clients must accept the domain transfer and handle all necessary setup on their end.
  • Gogo Marketing is not responsible for website downtime or issues once transferred.

7. SEO and LLM Performance

  • SEO/LLM results depend on market conditions, competition, and search engine algorithms.
  • We do not guarantee specific rankings, but we follow best practices to improve visibility.
  • Clients must actively participate in their SEO strategy by providing content and local business updates.

8. Refund & Cancellation Policy

8.1 Website Development

  • No refunds are issued once a project begins.
  • If a project is canceled before completion, the client will be billed for all work completed up to that point.
  • If a website is launched, full payment will be due.

8.2 Monthly Services (SEO, Hosting, Maintenance)

  • Clients may cancel monthly services (excluding web development/e-commerce) with 30 days’ notice.
  • No refunds will be issued for past payments.

9. Liability & Indemnification

  • Gogo Marketing is not liable for financial losses, website downtime, security breaches, or third-party hosting issues.

  • Clients agree to indemnify and hold Gogo Marketing harmless from any legal claims arising from misuse of services.

  • ADA Compliance: Accessibility compliance under the Americans with Disabilities Act (ADA) and the Web Content Accessibility Guidelines (WCAG 2.1) as defined by the World Wide Web Consortium (W3C) is the responsibility of the client. Accessibility tools or plugins provided or recommended by Gogo Marketing do not guarantee compliance, and the client assumes full liability for all accessibility-related remedies, remediation costs, and legal claims.

10. Accessibility Statement

Gogo Marketing strives to ensure digital accessibility for all users and visitors. We continually improve the user experience for everyone and apply the relevant accessibility standards where practical.

We follow the Web Content Accessibility Guidelines (WCAG 2.1) published by the World Wide Web Consortium (W3C) as a reference framework, but full compliance cannot be guaranteed.

While Gogo Marketing makes reasonable efforts to improve accessibility, we do not warrant that every page or feature meets every accessibility standard at all times. Third-party integrations, plugins, or embedded media may not be fully accessible.

Clients are responsible for maintaining ADA / WCAG 2.1 compliance on their own websites and for implementing any required updates or remediation measures. Gogo Marketing assumes no liability for accessibility claims, remediation costs, or related legal actions.

11. Non-Website Marketing & Consultation Services

Gogo Marketing also provides professional marketing, advertising, and business consultation services that are independent of website design, hosting, or development deliverables. These services may include but are not limited to marketing strategy, branding, campaign management, paid advertising, copywriting, IT infrastructure, ERP and CRM integration, and fractional CMO consulting.

All advice, recommendations, and marketing strategies are provided in good faith and based on professional experience, but results are not guaranteed. Clients are solely responsible for implementing and executing any strategies, recommendations, or advertising spend advised by Gogo Marketing.

Gogo Marketing is not liable for platform policy changes, algorithm updates, third-party software issues, or the performance of any advertising campaigns or external vendors.

Unless otherwise defined in a Statement of Work (SOW), proposal, or separate written agreement, the fee structure, billing terms, and payment policies for marketing and consulting services follow the same terms outlined in this Agreement.

12. Privacy Policy

  • Our Privacy Policy governs how we collect, use, and protect client information.
  • By using our services, you agree to our Privacy Policy.

13. Dispute Resolution

  • Any disputes will first be resolved through direct negotiation.
  • If unresolved, disputes will be handled under the laws of the State of California and Kern County.
  • Legal proceedings must be filed in Kern County, California.

14. Change to Terms

  • Gogo Marketing reserves the right to update or modify these terms at any time.
  • Clients will be notified of significant changes, but continued use of our services constitutes acceptance of updated terms.
